Interview with Henry and Bob


JM: Did you get off early based on good behavior?
Henry: In county jail, I received 5 days per day of incarceration, provided I had good behavior.
Bob: Yes, I got ten days shaved off my sentence. The way it works is ten days off of your sentence for every thirty days you are sentenced to. They call it "gain time". So for instance, I was sentenced to thirty days but because I behaved I was released after only twenty days.

JM: What is the most time off you can receive for good behavior?
Henry: The most time off that you can receive is 10 days as a trustee or orderly.
Bob: 120 Days on a Year Commitment (if you are sentenced to more than a year, you are going to prison and I have no idea how that works).

JM: What types of actions do you need to avoid in order to get time off?
Henry: You need to avoid fighting, the housing of contraband, and the breaking of jail rules.
Bob: Don't fight, follow the deputies orders, no contraband, no stealing, no sexual remarks/advances - all pretty common sense type on things.

If an officer at the jail tells an trustee that he has a cigarette for them when they go to the farm, is that considered contraband? If so is that entrapment?

It would only be entrapment if the officer then tried to get you in trouble after you took the cigarette. Is it contraband? Maybe, but come on, give the officer a break, it sounds like he was just being cool which is rare.

In Seminole Co., Fl. If sentenced to 30 days, can I expect any time off for gain time? Someone told me, No, not at the county level...
